Article 1 – Purpose and scope
These general terms and conditions of sale (T&Cs) govern sales of the Coconid refuge hoodie concluded on the COCONID shop website between COCONID (“the Seller”) and any natural person acting for non-professional purposes (“the Customer”). Any order constitutes full and unreserved acceptance of these T&Cs, which the Customer acknowledges having read before ordering. The applicable T&Cs are those in force on the day of the order.
Article 2 – Seller and contact
The website is operated by COCONID. The Customer may contact the Seller at any time via the contact form on the “Our story” page or by email at petitot.timothee@live.fr. A reply is given within 24 business hours.
Article 3 – Products
The Coconid refuge hoodie is a hooded sweatshirt with a front pouch designed to hold a cat weighing 5 kg maximum. It is available in black and pink, from S (EU 36) to XXL (EU 44). The essential characteristics, size guide and safety guidelines are shown on the product page, which the Customer is invited to read before ordering. Photographs are as accurate as possible; slight variations in colour may occur depending on the screen.
The product is designed for home use, under the constant supervision of the wearer. It is not a substitute for a cat carrier and must not be used in a car, on a bike or scooter, or while sleeping. The Seller cannot be held liable for use that does not comply with these guidelines.
Article 4 – Prices
Prices are shown in euros, including all applicable taxes. Shipping is free to mainland France. The applicable price is the one displayed when the order is confirmed. The “Duo” offer (two hoodies for €119.90) applies automatically in the cart from two items, any colours and sizes; it cannot be combined with other offers unless stated otherwise.
Article 5 – Ordering
The Customer selects the colour, size and quantity, then confirms the cart and enters their delivery details. Before paying, they can check the details and total price of the order and correct any errors. The order is final once payment is confirmed; an email confirming the order is then sent to the Customer. The Seller reserves the right to refuse an order in the event of a previous dispute with the Customer or suspected fraud.
Article 6 – Payment
Payment is made online at the time of ordering, using the methods offered at checkout (including bank card). Transactions are secured by the Shopify platform and its payment providers; the Seller never has access to the Customer's full banking details.
Article 7 – Delivery
Products are delivered to the address given by the Customer, in mainland France. The order is shipped within 5 business days maximum after payment is confirmed, then delivered within 5 business days maximum after shipping. A tracking number is sent by email as soon as the order ships.
In the event of late delivery, the Customer may, in accordance with Article L.216-6 of the French Consumer Code, require the Seller to deliver within a reasonable additional period and, failing that, terminate the contract in writing; they are then refunded all sums paid within 14 days at the latest. If a parcel is damaged, the Customer is invited to note reservations with the carrier and inform the Seller as soon as possible. The risk of loss or damage passes to the Customer when they take physical possession of the product.
Article 8 – Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the product to exercise their right of withdrawal, without having to give any reason. They notify their decision by an unambiguous statement, via the contact form or by email, stating their order number, or by using the model form in the appendix. The product must be returned within 14 days of this notification, complete and in its original condition. The Seller refunds all sums paid, including the initial delivery costs, within 14 days of the notification at the latest; it may withhold the refund until it has received the product or proof of its return. The refund is made using the same payment method as the order. The direct costs of returning the product are borne by the Customer, except in the case provided for in Article 9. The Customer may be held liable for any reduction in the value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.
Article 9 – “30-day money-back” commercial guarantee and size exchange
In addition to the statutory right of withdrawal, the Seller grants a 30-day “money-back” commercial guarantee from receipt. A Customer wishing to use it contacts the Seller with their order number; they receive the return address and send the product back unwashed, with its label. The refund is made within 14 days of receiving the returned product.
The first size exchange is free: the Seller covers the return costs and the shipping of the new size, subject to availability. This commercial guarantee does not deprive the Customer of their statutory guarantees.
Article 10 – Statutory guarantees
The Seller is bound by the statutory guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). The Customer has two years from delivery of the goods to act under the guarantee of conformity; they may choose between repair and replacement, subject to the conditions laid down by law, and, failing that, obtain a price reduction or termination of the contract. During the 24 months following delivery, any lack of conformity is presumed to have existed at the time of delivery. Under the guarantee against hidden defects, the Customer may choose between cancelling the sale and a price reduction, within two years of discovering the defect. To use these guarantees, the Customer contacts the Seller via the contact form or by email.
Article 11 – Liability
The Seller is not liable for damage resulting from use of the product that does not comply with its intended purpose or with the safety guidelines shown on the product page, in particular for a cat weighing more than 5 kg or in the absence of supervision. It cannot be held liable in the event of force majeure.
Article 12 – Personal data
The Customer's personal data is processed in accordance with the privacy policy.
Article 13 – Customer reviews
The reviews shown on the product page come from buyers of the refuge hoodie. Their origin and how they were collected are stated next to the reviews. No review is paid for.
Article 14 – Complaints and mediation
Any complaint may be sent to the Seller via the contact form or by email. The Seller endeavours to find an amicable solution to any dispute. In accordance with Articles L.612-1 et seq. of the French Consumer Code, the Customer has the right to use a consumer mediator free of charge to resolve a dispute amicably, after having tried to resolve it directly with the Seller.
Article 15 – Governing law
These T&Cs are governed by French law. Failing an amicable agreement, any dispute falls within the jurisdiction of the competent courts under ordinary law; a consumer Customer may refer the matter, at their choice, to the court of the place where they lived when the contract was concluded or when the harmful event occurred.
